US Citizenship and Immigration Services (USCIS) has announced the filing dates for applicants for adjustment of status to legal permanent residency (Form I-485), also known as the green card, for February 2024.
The US Department of State issues a Visa Bulletin each month. This Visa Bulletin provides the visa numbers available for issuance of the immigrant visa (if abroad) or approval of the Form I-485, if in the US (Final Action Dates chart). It also provides dates for when the Form I-485 can be filed for green card status in the US (Dates for Filing chart).
Also, each month USCIS announces whether it will use the Final Action dates chart or the Dates for Filing chart for accepting Forms I-485 applications to adjust status to legal permanent residency (the green card). For February 2024, USCIS will use the Dates for Filing chart.
For all family-based cases (beneficiaries of the Form I-130 immigrant visa petition), individuals must use the “Dates for Filing” chart in the Department of State Visa Bulletin for February 2024.

For all employment-based beneficiaries (with Form I-140 immigrant visa petitions on their behalf), they must use the “Dates for Filing” chart in the Department of State Visa Bulletin for February 2024. The Form I-140 can be for all categories, including the EB-1 (EB-1A Extraordinary Ability), EB-1B (Outstanding Researcher or Professor), EB-1C ((Multinational Executive or Manager), EB-2 (National Interest Waiver) or PERM labor certification application-based Forms I-140 in the EB-2 or EB-3 categories.
For the employment-based “Dates for Filing” chart, the EB1 preference visas for worldwide, Mexico and Philippines are now current. The EB2 preference visas for worldwide is at February 15, 2023, for India it is at May 15, 2012, and for China it is at June 1, 2020. The EB3 preference visas for worldwide category is at February 1, 2023, for China it is at July 1, 2018, and for India it is at August 1, 2012.

Applicants for adjustment of status and immigrant visas who have a priority date earlier than the date in the Visa Bulletin chart for their category may either file their Form I-485 application to adjust status to legal permanent residency with USCIS or start the processing abroad at a US consulate.
