New Restrictions on Fiance Visa Petitions

Under the International Marriage Broker Regulation Act (IMBRA), the petitioner of a K-1 fiance visa petition or K-3 petition for an alien spouse must submit information on any criminal conviction for specified crimes with the Form I-129 nonimmigrant visa petition. Also, IMBRA imposes time and numerical filing limitations, establishes a waiver of these limitations (including a general waiver, an extraordinary circumstances waiver in cases involving a history of violent offenses, and a mandatory waiver in cases where the petitioner was subjected to battery or extreme cruelty), and requires the US Citizenship and Immigration Services (USCIS) to track repeated petitions.
